Terms & Conditions

All our tiles are supplied subject to the terms and conditions of sale set out below.


1. In these Conditions: 'We', 'Us' and 'Our' refer to The Norton Tile Company Limited (registered in England 3091362 Registered Office: Brandon Hill Colebrook Lane Watersfield Pulborough RH201NA). 'You' and ‘Your’ refers to any person or persons with whom a written or oral contract is made to supply Goods.
Goods means the products which We are to supply to You in accordance with these Conditions
Conditions means the standard terms and conditions of sale set out in this document and (unless the context otherwise requires) includes any special terms and conditions agreed in Writing between You and Us
Contract means the contract for the purchase and sale of the Goods
Writing includes e-mail
The numbering in this document is for convenience only and shall not affect the interpretation of these Conditions
The singular includes the plural and vice versa and any gender includes any other gender

2. We shall sell and You shall purchase the Goods in accordance with any written or oral quotation of Ours which is accepted by You, or any written or oral order of You which is accepted by Us, subject in either case to these Conditions, which shall govern the Contract to the exclusion of any other terms and conditions

3. The price of the Goods shall be Our quoted price

4. Subject to any special terms agreed in writing between Us and You, payment for the Goods is due once We have notified You that the Goods are ready for dispatch or collection.  Payment for the Goods must be made prior to dispatch or collection. (For orders that include tiles that are particularly personal to You we reserve the right to ask for payment of  a proportion of the price in advance.)

5. The Goods will be delivered to the delivery address specified by You. Delivery of the Goods shall be complete when we deliver the Goods to You.

6. Any dates quoted for completion or delivery of the Goods are approximate only. We will make every effort to complete the Goods on time (or, if no date has been agreed, within a reasonable time from the date of Your order) but we cannot be held responsible for delays due to unexpected issues arising during the making or decorating of tiles or other circumstances beyond our control. We shall have no liability for late delivery except where time has been made the essence of the contract and agreed in writing by both You and Us at the time the order is made.

7. You agree that you will inspect the Goods as soon as reasonably possible after delivery and that any defect in the quality or condition of the Goods or their failure to correspond with specification shall be notified to Us in writing within ten working days.
8. We will accept returns by You of unwanted tiles to our workshop provided they are received by Us in saleable condition and within 30 days of delivery. Please contact Us in advance of returning any tiles to confirm arrangements. Hand-painted tiles are painted to Your order and are therefore not returnable.

9. Most ceramic tiles are subject to crazing of the glaze over a period of time. Such crazing is a characteristic of glazed tiles and is not an imperfection. Consequently no liability is accepted by us for any crazing of tiles supplied by us as Goods.

10. Our tiles are hand-crafted and hand-decorated and as such are subject to minor variation in colour and dimensions. Consequently no liability is accepted by Us for any minor variation in colour or dimensions of tiles supplied by us as Goods.

11. No claim shall be made by You in respect of any defective condition or failure to meet specification of Goods once they have been fixed, or any attempt has been made to fix them.

12. Subject as expressly provided in these Conditions, all warranties, conditions or other terms implied by statute or common law are excluded to the fullest extent permitted by law.

13. Where any valid claim in respect of any of the Goods which is based on a defect in quality or condition of the Goods or their failure to meet specification is notified to Us in accordance with these Conditions, We shall be entitled to replace the Goods (or the part in question) free of charge or to refund to You the price of the Goods.

14. We will not be liable to You for any loss of revenue, profits, anticipated savings, goodwill or business opportunity, for any injury to Your reputation or for any losses that are not reasonably foreseeable by both of You and Us at the time Your order is accepted.

15 Our entire liability to You under or in connection with the Contract shall not exceed the price paid by You for the Goods. 

16. Despite the limitations in paragraphs above, we do not in any way limit our liability to You for death, personal injury or fraud.

17. It is agreed that having regard to Our interest in limiting the personal liability and exposure to litigation of directors, officers and employees of Us, You will not bring any claim against any of Our directors, officers or employees personally in respect of any damage or loss You may suffer in connection with Goods supplied by Us. The terms of this above paragraph will not limit or exclude Our liability for the acts or omissions of Our directors, officers or employees.

18. You acknowledge that We have set Our prices and entered into this agreement in reliance upon the limitations of liability and the disclaimers of warranties set forth herein, and that the same form an essential basis of the Contract between You and Us.

19. Except to the extent that directors, officers or employees of Us can benefit from clause 17 herein, no Contract will create any right enforceable by virtue of the Contracts (Rights of Third Parties) Act 1999 by any person not a party to it.

20. Where You buy as a consumer, these Conditions will not affect your rights under law which cannot be otherwise excluded.
21. Copyright on all designs and decoration will remain with Us.

22. If any provision of these Conditions is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these Conditions and the remainder of the provision in question shall not be affected thereby

23. The Contract shall be governed by the laws of England
